These Terms of Use (“Terms”) govern your access to and use of the Move Break mobile application (the “App”) operated by Stable Genius Productions LLC (“we,” “our,” or “us”). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. License to Use the App
We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on a compatible Apple device that you own or control, solely for your personal, non-commercial use, subject to these Terms. You may not copy, modify, distribute, sell, lease, sublicense, or reverse-engineer the App or any part thereof.
2. Description of the App
Move Break is a wellness application designed to remind users to take regular movement breaks during periods of sedentary activity. The App provides customizable reminder intervals, movement break logging, progress tracking, and an optional citizen-science research participation feature. The App does not provide medical advice, diagnosis, or treatment. The movement suggestions and reminder intervals are based on published research but are for informational and wellness purposes only.
3. Health Disclaimer
The App is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or health condition. The movement break reminders and exercise suggestions are general wellness information only. You should consult with a qualified healthcare provider before beginning any new exercise routine or making changes to your physical activity, particularly if you have any pre-existing health conditions or concerns. You use the App and follow any movement suggestions entirely at your own risk.
4. Citizen-Science Research
The App offers an optional citizen-science research feature. If you opt in, your anonymized usage data will be collected and may be used for academic research purposes as described in our Privacy Policy. Participation is voluntary. You may opt out at any time. By opting in, you consent to the use of your anonymized data for research purposes. You will not receive compensation for participation in the research program.
5. User Conduct
You agree not to: use the App for any unlawful purpose; attempt to gain unauthorized access to the App or its systems; interfere with or disrupt the integrity or performance of the App; attempt to reverse-engineer, decompile, or disassemble the App; or use the App in any manner that could damage, disable, or impair the App.
6. Intellectual Property
The App and all content, features, and functionality (including but not limited to text, graphics, logos, icons, software, and the design, selection, and arrangement thereof) are owned by Stable Genius Productions LLC and are protected by United States and international copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right in the App or its content beyond the limited license described in Section 1.
7. Disclaimer of Warranties
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, STABLE GENIUS PRODUCTIONS LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR USE OF OR INABILITY TO USE THE APP; (B) ANY INJURY OR HEALTH ISSUE ARISING FROM FOLLOWING MOVEMENT SUGGESTIONS IN THE APP; OR (C) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN.
9. Indemnification
You agree to indemnify, defend, and hold harmless Stable Genius Productions LLC and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the App or your violation of these Terms.
10. Termination
We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your license to use the App will immediately cease. You may terminate your use of the App at any time by deleting it from your device.
11. Changes to These Terms
We may update these Terms from time to time. We will notify you of any material changes by posting the updated Terms within the App and updating the “Last Updated” date. Your continued use of the App after the effective date of any changes constitutes your acceptance of the revised Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in the State of New York.
